1.         DEFINITIONS

            In this document the following words shall have the following meanings:

1.1    "Buyer", “You” means the organisation or person who buys Goods from the Seller.

1.2    "Goods" means the articles to be supplied to the Buyer the Seller.

1.3    "Intellectual Property Rights" means all patents, registered and unregistered designs, copyright, trademarks, know-                how and all other forms of intellectual property wherever in the world enforceable.

1.4    "List Price" means the list of prices of the Goods maintained by the Seller as amended from time to time.

1.5    "Seller", “We” means Voltage Cruiser Bikes.

1.6    “T&C” means Terms and Conditions.

2.        GENERAL

2.1    Please read the following Terms and Conditions carefully before placing your Order. They contain important     information about the ordering, processing, and delivery of goods, including limitations of liability. These T&C shall apply to all contracts for the sale of Goods by the Seller to the Buyer.

2.2    Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2.3    All care is taken in the preparation of the information and published material on this site.
Voltage Cruiser Bikes does not make any representations or give any warranties about its accuracy, reliability, or suitability for any particular purpose.

2.4    To the extent permissible by law, Voltage Cruiser Bikes will not be liable for any expenses, losses, damages (including indirect or consequential damages) or costs which may be incurred because of the information being inaccurate or incomplete in any way or any reason.

3.    PRICE AND PAYMENT

3.1    The price shall be that in the Seller’s current List Price, or such other price as the parties may agree in writing. The price is in AUD and inclusive of GST.

3.2    Prices for our products are subject to change without notice, prices will not be changed after an order has been submitted.

3.3    Accepted methods of payment are Credit/Debit Card, Pay Pal, Bitcoin, Ethereum and Cash On pick up or local delivery.

3.4    You must be eighteen 18 to use this site and order any product, if you are under 18 you cannot place orders with us.

4.    DESCRIPTION OF PRODUCTS

Any description given or applied to the Goods is given by way of identification and information only, there are many factors that alter the outcome. Examples of these are the distances traveled from a single battery charge, speed of bike, weight of bike.

 

5.    DELIVERY OF GOODS

5.1    Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

5.2    When an order is placed you are entering into an agreement to make a purchase, orders will be deemed to be received when Voltage Cruise Bikes sends you a confirmation email.

5.3    Voltage Cruiser Bikes will process and ship your order within 2 business days of receiving payment and will then provide a tracking number or link to you by email.

5.4    All products will be shipped by a company of our choosing like Aust Post, TNT or Startrack, delivery estimates between 5 to 7 business days.

5.5    We will not deliver to PO box addresses, and a signature will be required for receival.

5.6    If the Seller is unable to deliver the Goods for reasons beyond its control, then the Seller shall be entitled to place the Goods in storage until such times as delivery may be affected and the Buyer shall be liable for any expense associated with such storage.

5.7    Do not accept badly damaged boxes from couriers, it was not dispatched by us in that condition, contact us immediately.

 

6.    RETURNS/REFUNDS

Voltage Cruiser Bikes will not accept returns because you have changed your mind, if in the rare case that your bike is damaged or faulty, we will refund, replace, or repair damaged products or bike in accordance with our Warranty Conditions.

7.    WARRANTY

7.1    Please read our full Warranty conditions HERE.

7.2    Warranty on Bike Frame is 2 years.
7.3    Warranty on all electrical components 1 year.
7.4    Wear and Tear is not covered by warranty.

8.    MODIFICATIONS

8.1    If you modify any of our products you acknowledge and agree that you do so at your own risk and Voltage Cruiser Bikes will not be held liable in any way.

8.2    Australian guidelines allow a maximum output of 250W motor, Restricted to 25 km/h for street-legal use.

8.3    By fitting a throttle or a modification increasing the performance will negate the street legality of our bikes, be deemed a modification outside of Australian guidelines therefore restricting them to private property/off road use.

 

9.    LIABILITY

9.1    No liability of any nature shall be incurred or accepted by the Seller in respect of any representation made by the Seller, or on its behalf, to the Buyer, or to any party acting on its behalf, prior to the making of this contract where such representations were made or given in relation to:

9.1.1    the correspondence of the Goods with any description.

9.1.2    the quality of the Goods; or

9.1.3    the fitness of the Goods for any purpose whatsoever.

9.2    To the extent permitted by law we will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise; and our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.

10.    RELEASE & WAIVER OF PUBLIC LIABILITY & INJURY

10.1    Riding an electric bike comes with risks can be dangerous, and cause injury or death, to the rider, bystanders, and damage to property. By buying any electric bike from Voltage Cruiser Bikes, you the customer take full responsibility of your own safety, and the safety of others, and agree to follow your local governments road rules and laws. If you modify any parts or modifies the power or increases the speed limits above the legal limit, of any model bike sold by Voltage Cruiser Bikes you do so at your own risk. Voltage Cruiser Bikes, their owners and employees will not be held liable for any injuries, loss of income, property damage caused from the purchase from Voltage Cruiser Bikes. You the customer understand all the risks and agree to waive and release Voltage Cruiser Bikes from any responsibility and liability to you the customer and the public.

10.2    Nothing contained in these Terms and Conditions shall be construed so as to limit or exclude the liability of the Seller for death or personal injury as a result of the Seller’s negligence or that of its employees or agents.

11.    LIMITATION OF LIABILITY

Where any court or arbitrator determines that any part of these terms and conditions, for whatever reason, unenforceable, the Seller shall be liable for all loss or damage suffered by the Buyer but in an amount not exceeding the original contract price.

12.    GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the law of Queensland, Australia.
